IN CONSIDERATION OF the mutual covenants and promises in this Agreement, the receipt and sufficiency of which consideration the Parties acknowledge, the Lessor rents the Property to the Lessee on the following terms:

Cloth Diaper Library MCM Inc. (We/Us) agree to rent a Trial Kit as described in your booking confirmation to the client (You/Your) for the period detailed in your booking confirmation. 

 

Pick Up of Trial Kit

You are responsible for picking up the Trial Kit at the address specified on the booking confirmation. If there are circumstances beyond your control that prevent you from picking up the Trial Kit on time, please contact us at least 48 hours so we can make alternate arrangements. We do not extend the hire period nor do we refund fees due to late pickup. Please get in touch if you cannot pick up the Trial Kit within 5 days following your original pick up date.

Return of the Kit 

 

All items in the Trial Kit must be dry and clean when returned to us. It is essential the Trial Kit is returned on time, unless an agreement has been reached to extend the initial rental period. Such requests must be made in writing and are dependent on the Trial Kit not already being reserved by another client.

You agree to return the Trial Kit immediately following the end of the rental period to the specified address on the booking confirmation. If there are circumstances beyond your control that prevent you from returning the Trial Kit on time, please contact us at least 48 hours so we can make alternate arrangements.  There is a late fee of $5.00 per day that the diapers are returned late without any notice.  

 

Care & Condition of Rented Items 

 

You agree that the Trial Kit and its contents will be used in a non-smoking home. 

You agree to use the cloth diapers and accessories in a good and careful manner and only for the purpose for which they were designed. 

You agree to only wash and dry them as per the written instructions provided. Diapers and accessories must be washed and dried as per these instructions and all components must be clean and dry when returned to us. 

You agree to not use bleach (sodium hypochlorite) or any other additives. 

In the event of any loss or damage other than fair wear and tear you agree to pay us in full the cost of replacements.

If you care for the Trial Kit diapers and accessories as instructed no harm should come to them. Some light staining and/or greying to the diapers is to be expected. 

Each diaper is carefully inspected and cleaned before each rental period. In the event of any problem with the Trial Kit diapers or accessories you agree to inform us in writing immediately. 

You agree that you are aware that the items rented to you are likely to be previously used. Occasionally there may be new items in our kits but as we are a lending library the vast majority of our stock is used items.

 

Your Privacy

 

Personal information provided to us will remain private and confidential. Your information will never be given to any other agencies unless otherwise specified.  If you choose to use the discount codes we provide for some retailers we may share your name and email address with the retailer to verify with them that you are a client of Cloth Diaper Library MCM Inc. and therefore entitled to the discount. From time to time you may be contacted by email, telephone or post by Cloth Diaper Library MCM Inc. to let you know of any events or information we feel may be of use to you.

 

Liability

 

You release and forever discharge Cloth Diaper Library MCM Inc., its officers, directors, employees, agents and volunteers and their heirs, legal representatives and assigns, from all actions, causes of action, damages, claims and demands whatever, which You, your heirs, legal representatives or assigns may have against Cloth Diaper Library MCM Inc. by reason of the use of any diapers or other products or services provided to You by Cloth Diaper Library MCM Inc. whereby any injury or damage may be sustained by your child as a result of an issue of such product or service. AND FURTHER You agree to indemnify The Cloth Diaper Library MCM Inc. its officers, directors, employees, agents or volunteers and their heirs, legal representatives and assigns, against all actions, damages, claims and demands which may be brought against any of them by or on behalf of Your child by reason of the use of any diapers, other products or services by such child both at present or in the future. You have read over the above release and agreement to indemnify and understand the terms thereof and the responsibilities which You have assumed thereunder.
